Study on the Integrational mechanism of Chemical Substances and the Work Plan of Making Classification and Refinement Project.

On January 16, 2019, the amendment of Taiwan's Toxic Chemical Substances Control Act was published and renamed the Toxic and Concerned Chemical Substances Control Act by Presidential Order to expands the management of chemical substances, empower the authority to carry out the compliance check and implement practices that prevent or control any risk. This project assisted in collecting opinions from all interested parties and amending the “Permit Regulation and Approval Regulation for Toxic Chemical Substances”, the "Handling Regulation and Release Quantities Records Regulation of Toxic Chemical Substances", the "Toxic and Concerned Chemical Substances Labeling and Materials Safety Data Sheets Regulations", and the " Environmental Protection Administration Executive Yuan: Principles of Screening and Identification of Toxic Chemical Substances". Given the increasing quantity of chemical substances regulated by the Act and a surge of multi stakeholder, the project helped to develop the complementary measures called "one place (or one operator) one license" and set up a plan to update the online system with new license application, review and operation record declaration functions. Since there is no singular regulation or competent authority to apply a general and coherent management scheme that apply to all the chemicals placing on the market in Taiwan. The project has proposed the “Chemical Substances Control Act” with a total of 36 articles. The draft includes provisions on substance registration, assessment, information collection, disclosure and sharing. The project examined the content of Globally Harmonized System of Classification and Labelling of Chemicals, and the enforcement actions taken by the European Union based on “Regulation on Registration, Evaluation, Authorization and Restriction of Chemicals”, and “Regulation on Classification, Labelling and Packaging of Chemical Substances and Mixtures”. The materials compiled can be used as a reference for future policy review. We also have organized a seminar, the consultation meetings, and the expert meetings which aimed to increase the management and compliance capacity of local government and enterprise, and to adopt the opinions from the public to refine the legislative proposals.
